Terms of Service

Welcome to the professional cuddling services provided by Devin Olivia Barton-Torres (referred to as “I,” cuddlist,” “we,” “us,” or “our”). By engaging in our services, you (referred to as the “Client,” :you,” or “your”) agree to the following terms and conditions. Please review and sign the document.

Scope of Services
1.1. Cuddlist provides professional cuddling services with the intention of promoting relaxation, comfort, and emotional well-being. These services are strictly platonic in nature and are intended for therapeutic purposes only.
1.2 The client understands and acknowledges that the cuddling sessions may involve physical contact, such as hugging, holding hands, or gentle touch. This will be carried out within the agreed boundaries and guidelines set by both parties.

Code of Conduct:
2.1 The Client agrees to treat the Cuddlist with respect and courtesy throughout the duration of the session.
2.2 The Client understands that any form of non-platonic activity, inappropriate behavior, or harassment is strictly prohibited and will result in immediate termination of the session without a refund.
2.3 The Client and Cuddlist will discuss agreed upon boundaries, including firm limits. Violation of these agreements will result in immediate termination of the session without a refund.
2.4 The Client acknowledges that open communication is essential during the session. If at any time the Client or Cuddlist feels uncomfortable or seeks to modify the session or agreements,they will speak up.

Confidentiality:
3.1 The Cuddlist will maintain strict confidentiality regarding all personal information shared by the Client during the session, except in cases where the law requires disclosure or if there is an immediate risk of harm to the Client or others.
3.2 The Client agrees to respect the confidentiality of the Cuddlist and other clients. Client agrees to not disclose any personal or sensitive information shared during the session without explicit consent.

Liability
4.1 The Client understands and acknowledges that engaging in cuddling sessions involves inherent risks, and they voluntarily assume all responsibility for any physician or emotional effects that may arise from such sessions.
4.2 The Cuddlist shall not be held liable for any injuries, damages, or losses incurred by the Client as a result of their own actions or decisions during or after the session.
Payment and Cancellation:
5.1 The client agrees to pay the agreed-upon fee for the cuddling session prior to beginning the session. Payment methods will be communicated and agreed upon between the Client and the Cuddlist.
5.2 If the Client needs to cancel or reschedule a session, they must provide at least 24-hours notice. Failure to do so may result in a failure fee up to the total cost of the cuddling session.
5.3 In the even the Cuddlist needs to cancel or reschedule a session, the Client will receive a 24-hour notice with the exception of emergency situations. The Cuddlist will provide Client with options to reschedule their session.

Consent and Release
6.1 The Client acknowledges they are engaging in cuddling services voluntarily and of their own free will.
7.2 The Client releases and discharges the Cuddlist from any claims, liabilities, or damages, whether known or unknown, arising out of or in connection with the cuddling session.
6.3 The Client understands cuddling sessions are not a substitute for professional therapy or medical treatment. If the Client requires therapeutic or medical treatment, they are encouraged to seek support from a licensed professional

Modification to Terms:
7.1 The Cuddlist reserves the right to modify or update these Terms of Service at any time, without prior notice. It is the responsibility of the Client to review these terms periodically for any changes.
7.2 Continued use of cuddling services after any modifications to the Terms of Service constitutes acceptance of the updated terms.

Governing Law and Jurisdiction
8.1 These Terms of Service shall be governed by and construed in accordance with the laws of New Jersey. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.

By engaging in professional cuddling services, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you have any questions or concerns, please contact me for clarification before proceeding with the session.
